New EU General Court sanctions decision: Case T‑406/13 Gossio
Gossio concerned an application for annulment of Regulation 560/2005, Council Decision 2010/656/CFSP and Council Implementing Decision 2012/144/CFSP (establishing restrictive measures in view of the situation in Côte d'Ivoire), and of the decision of 17 May 2013 confirming and prolonging the above mentioned restrictive measures in so far as they maintained the listing of the applicant. Mr Gossio later amended his application to include annulment of Council Implementing Decision 2014/271/CFSP and Council Implementing Regulation 479/2014 in so far as they maintained his listing. Requests by Mr Gossio to the Council to remove his name from the relevant sanctions list had been repeatedly rejected. The General Court has now annulled Council Implementing Decision 2014/271/CFSP and Council Implementing Regulation 479/2014 in so far as they affected Mr Gossio.

According to press reports in the Ukranian media, the spokesperson of the Court of Justice of the European Union said it was incorrect for V.F. Yanukovych and his sons to have made their applications in the English language, and that this had hampered their cases. If any such statement was in fact made by a Court spokesperson, it was wrong and should never have been made.

On 5 June 2015, the European Union took the long overdue step of removing sanctions on our client Viktor Viktorovych Yanukovych, younger son of Ukrainian president, Viktor Fedorovych Yanukovych. No reason was given by the Council for his delisting. It might look like backing away from the unjust imposition of sanctions has been made easier by the tragic death of Mr Yanukovych in March this year although very often sanctions remain in place against the estate of a deceased target for years after their death.

Following an application to Interpol by Joseph Hage Aaronson LLP on behalf of President Yanukovych, President Yanukovych is no longer listed as a “wanted person” by Interpol. Further, Interpol member countries have been blocked by Interpol from access to data concerning President Yanukovych held by Interpol.

Oleksandr Yanukovych has lodged a claim with the European Court of Human Rights on the grounds that Ukraine has repeatedly breached his human rights. His application asks the Court to declare violations of his rights under the European Convention of Human Rights including the right to peaceful enjoyment of property (Article 1, Protocol 1), his right to a fair trial (Article 6), and his right not to be discriminated against because of his status as the son of President Yanukovych (Article 14).

President Yanukovych has lodged a claim with the European Court of Human Rights on the grounds that Ukraine has repeatedly breached his human rights. Today oral arguments were heard against the EU Sanctions imposed on Viktor Fedorovych Yanukovych and Oleksandr Viktorovych Yanukovych in 2014 and 2015. The Applicants argued that the Sanctions had been imposed for impermissible political reasons, that they did not fulfil lawful sanction listing criteria set by the Council, and that the Council’s assessment that they did fulfil such criteria was wrong.

The General Court of the European Union has annulled the sanctions that the EU imposed in 2014 on Viktor Viktorovych Yanukovych, a member of Ukraine’s parliament, the Verkhovna Rada, and one of the sons of Ukraine’s President Viktor Fedorovych Yanukovych. The Court did not determine the merits of a related challenge to the 2015 measures, which was brought after Mr. Yanukovych’s death.
